I am also to observe, that Mr. Secretary Hardy is informed that the present form
under which Crown lands are granted, provides for the formation of "public or common closed drains" and that he cannot consider it necessary, in addition to the power thus placed in the hands of the local Government that the Military Authorities should be invested with a privilege or right of way though private lands, or of building
sewers thereon.
I am to add, that when it is contemplated to erect buildings on War Department land, the drainage should be designed with a view to its connection with the public or common drains.
